COMPETITION TERMS AND CONDITIONS

The terms and conditions contained herein, together with any other information on how to enter and win prizes in this competition, referred to as the “G’day Mate” Competition or such other similar reference (“Competition”), comprise the terms and conditions (“Terms and Conditions”) to which you submit when entering the Competition.

 

If you submit an entry or read the Terms and Conditions and thereafter take any steps howsoever with respect to submitting an entry, or otherwise participate in this Competition, you are deemed to have accepted these Terms and Conditions and for the purposes of these Terms and Conditions you are referred to as an “Entrant”.

 

“Entrants” warrant that they have read, understand and agree to be bound by these Terms and Conditions.

 

The promoter of the ‘G’day Mate’ Competition is Amazing People Worldwide Trust of Suite 204, Eastside Tower, 6 Waterfront Place, Robina, Queensland, 4226, Australia.

Eligibility

 

Entry is open to all Gold Coast Schools in South-East Queensland (both Primary and Secondary).

 

Please note:  As entrants will be under the age of 18, permission must be obtained from their parents or legal guardian to enter.  Click here for permission form.

How To Enter

1. Download the lyrics and watch the example video by clicking here.
 

2. Click on the 'Enter Here' button and fill out the information form, including parent/guardian consent.

  • By ticking the box, the teacher/school acknowledges they have parent/guardian consent for each student who appears in the video performance.

     

 

Note: Early Learning Centres are only required to upload a video of their group performing/taking part in the chorus of the ‘G’day Mate Song.’

First and second place winners will be announced on our website and social media sites on Friday, 22 November 2019, for the 'G'day Mate' Song Competition.

These gift baskets provide winning schools a chance to use the contents for fundraising within the school. These prizes which have been generously donated by local businesses could be used for a raffle, a silent auction, or an incentive/rewards program for students. Schools should note the expiry dates on the gifted vouchers, as no replacement vouchers will be given should they expire.

 

Please note: Amazing People Worldwide Trust is not responsible or liable for the goods or services supplied by local Gold Coast business for the gift baskets that form first and second prize in the 'G'day Mate' Song Competition.   

 

The prizes within the gift baskets are as described. They have been acquired from local Gold Coast businesses as donated prizes for the G'day Mate Song Competition. They are valid and as described in our terms and conditions and promotional materials. We know of no other restrictions other than the expiry dates as displayed with the list of prizes.

 

Amazing People Worldwide Trust is not responsible for false or misleading information with regards to the prizes in the gift baskets donated by local Gold Coast businesses.  These vouchers are subject to the businesses inherent restrictions and limitations as per the terms and conditions of use and as displayed on their website or products.  Please refer directly to the local business owner/s and/or their website/s for further information on their product and terms and conditions. 

 

At the time of the 'G'day Mate' Song Competition promotion and launch, to the date that votes close and competition winners are announced, Amazing People Worldwide Trust understands that the goods and services are as described by local Gold Coast businesses.  The terms and conditions of the prizes and vouchers in the gift basket may be changed or amended at any time at the discretion of the business owner. Amazing People Worldwide Trust will update the 'G'day Mate' Song Competition website with any changes to the prizes in the gift baskets on the business owners notification and advice. 

 

Amazing People Worldwide Trust does not take any responsibility or liability for any local Gold Coast business' failure to honour and supply the product or service as per our 'G'day Mate' Song Competition.

Voting/Judging

 

All video entries will be available to view on our Amazing People Music website via the competition entry page.

 

Prizes will be determined from the results of the highest voted videos in each category.

 

To vote, simply select your favourite video and enter your email address in the form provided.

 

Only one vote per day will be accepted.

​

The winner will be announced on our website and social media sites on the dates listed in our ‘Competition Timeline’.

 

The promoter’s decision is final and will be binding on each person who enters the Competition. The promoter will not enter into correspondence regarding the Competition results or winning entries.

 

The promoter shall have the right, at its sole discretion and at any time, to change or modify these terms and conditions, such change shall be effective immediately upon posting to this webpage.

 

If there is any event that prevents or hinders the Promoters’ conduct of the Competition or the Promoters’ ability to deliver the prize(s) to the prize winner(s) of the Competition, the Promoter may, in their discretion, cancel the Competition and recommence it at another time under the same conditions, or select another winner, being the video voted as the next most popular in that category.

 

The promoter accepts no responsibility can be accepted for entries not received for whatever reason within the timelines outlined/or at all.

 

The promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of the Competition. The promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration to entries.

 

To the full extent permitted by the law, the promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the Competition or accepting a prize, including without limitation non-receipt of any prize.

Entries

 

When submitting an entry, an Entrant must comply with all applicable laws and regulations and must not post, submit or transmit any video, information, image, text or other materials of any kind whatsoever that:

 

1. Is not original material or material in which the Entrant owns copyright, unless the Entrant is authorised by the copyright owner to post or transmit that material for the purposes of the Competition;

2. Violates or infringes upon the rights of any other person, including a person’s intellectual property or privacy rights;

 

3. Is unlawful, offensive, threatening, abusive, defamatory, derogatory, obscene, vulgar, profane or indecent in nature;

 

4. Vilifies, insults or humiliates any person on the basis of race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability;

 

5. Identifies a person, other than the Entrant, unless the Entrant has obtained the consent of that person to submit the material for the purposes of the Competition and consents to, and submits to Competitions Terms and Conditions.

 

6. The entrant remains liable for the content of any video, information, image, text or any other material submitted as an entry and indemnifies Amazing People Worldwide Trust against any claims whatsoever and howsoever arising with respect to the Entrant’s entry.

 

7. Without limiting any other terms herein, the Entrant indemnifies Amazing People Worldwide Trust and its directors, officers, employees, and agents (“Indemnified Parties”) on a full indemnity basis for all direct and consequential loss, causes of actions, demands, damages, fines, penalties or other costs or expenses of any kind or nature whether monetary or capable of being converted into money, suffered by any of the Indemnified Parties, as a result of, or caused or contributed to by, any act or omission, including any breach of any of these terms and conditions, by the Entrant.

Permission, Privacy and Collection of Information Notice

 

An entrant gives permission for the promoter, Amazing People Worldwide Trust, and its assignees, successors, licensees, legal representatives, employees and agents (‘Amazing People Worldwide Trust’) the irrevocable right to use their name/photograph/image/audio recording/video recording and likeness in all forms and manner.

 

(‘My image’) may be used for the purposes of advertising, media publicity, publication, general display or for any other purposes in whole or in part, including but not limited to publication on Internet web sites, broadcasts and any other publications, as released to or by Amazing People Worldwide Trust (‘Publication’).

 

I waive any interest that I have in the copyright to ‘My Image’ now or at any future time and acknowledge that I am not entitled, nor shall I in the future be entitled, to receive any payment or consideration in respect of it and agree to make no claim against Amazing People Worldwide Trust/Amazing People Worldwide/Amazing People Music/Amazing People Schools for any payments for the ‘Publication’ of ‘My Image’.

 

I understand Amazing People Worldwide Trust cannot control unauthorized use of ‘My Image’ by persons not associated with Amazing People Worldwide Trust upon the ‘Publication’ of ‘My Image’.

 

I forever waive any right to inspect or approve any ‘Publication’ of ‘My Image’ by Amazing People Worldwide Trust.

 

I release and indemnify Amazing People Worldwide Trust from any loss, damage, cost, expense, or claim (including consequential loss) connected with the ‘Publication’ of ‘My Image’, including action for defamation, breach of privacy, or copyright.

 

We will use the collection of your ‘personal information’ to provide you with information on our products and services.

Entrants confirm and promise that their entry does not infringe the rights of any other person.

 

The Competition hosted by Amazing People Worldwide Trust is in no way sponsored, endorsed, administered by, or associated with Facebook.

 

By entering this competition, an entrant indicates their acceptance and agreement to be bound by these terms and conditions.

With regard to Privacy Act 1988, the term ‘personal information’ when used in this privacy policy, in general terms, refers to any information that can be used to personally identify you. It may include, but is not limited to, your name, address, telephone number, email address and occupation.

The promoter takes its privacy and data security obligations seriously.

Your name, contact email and school/group category.

 

Any personal information that you provide to the promoter in accordance with these Terms and Conditions will be held in accordance with the Promoter’s Privacy Policy.

WHAT INFORMATION WILL APWW COLLECT ABOUT ME?

When you participate in, access or sign up to any of APWW services, events, activities or online content such as newsletters or competitions we may request information from you that includes your personal information such as your name, telephone number, postal address, email address.

 

We also collect personal information about your interactions with us, including any contact we have with you by telephone, email or online.

 

By providing your personal information you enable APWW (and where applicable its contractors) to provide you with services, information and content. You do not have to provide your personal information to us but, if you do not provide the information requested, we may not be able to provide you with the services, information or content you have requested.

 

HOW WILL APWW COLLECT MY INFORMATION?

 

We generally collect personal information from you if you choose to provide your details through our websites, social media sites, apps and e-commerce platforms.

 

We may also collect personal information from you in person (for example when you attend our trade shows, seminars, events or otherwise liaise with our employees).

 

Sometimes, we may collect your personal information from someone else such as our related companies, agents, representatives or service providers and your organisation and representatives.

For example, when conducting competitions we collect names and contact details of entrants to ensure we can meet our obligations under laws about ‘trade promotions’ (e.g. the Lotteries and Art Unions Act 1901 (NSW)).

 

HOW WILL APWW USE THE INFORMATION IT COLLECTS ABOUT ME?

You will need to provide us with all relevant details of your complaint and any supporting evidence.

 

We will refer your complaint to our Privacy Officer who will investigate your complaint and determine the steps that we will undertake to resolve it. CHANGES TO THIS PRIVACY POLICY

 

This Privacy Policy may be updated from time to time so you should check it each time you visit any of our websites. The date of the most recent revisions will appear at the bottom of this Privacy Policy. If you do not agree with the most recent revisions, please do not continue to use our websites. If you do continue to use our websites, you accept the terms of our updated Privacy Policy.
